Terms & Conditions

Welcome to AXOMED ("AXOMED", "we", "us", "our"). These Terms & Conditions ("Terms") form a legally binding agreement between you and AXOMED, a telehealth platform operating in the Islamic Republic of Pakistan. By accessing our website, portals or services, you agree to these Terms. If you do not agree, please do not use the platform.

1. About the Service

AXOMED provides online health assessments, virtual consultations with licensed healthcare professionals, personalized treatment plans, e-prescriptions, pharmacy fulfillment, laboratory coordination and doorstep delivery of medication across Pakistan. Services are provided in accordance with applicable Pakistani laws, including the regulations of the Pakistan Medical & Dental Council (PMDC), the Drugs Act 1976, and the Prevention of Electronic Crimes Act 2016 (PECA 2016).

2. Eligibility

• You must be at least 18 years of age to use AXOMED services.
• You must be a resident of Pakistan and provide accurate, complete and current information.
• You must not use the platform for any unlawful purpose or in a manner that violates Pakistani law.
• Minors may only use the platform under the supervision of a parent or legal guardian.

3. Medical Disclaimer

• Content on this platform, including product descriptions and program information, is for informational purposes only and does not constitute medical advice.
• Prescriptions are issued only after an online consultation with an independent, licensed provider at the provider's professional discretion.
• Results vary based on starting condition, adherence and individual response. AXOMED does not guarantee specific outcomes.
• You are responsible for disclosing your complete medical history, allergies and current medications to your provider.

4. Accounts and Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• We may suspend or terminate accounts that violate these Terms or applicable law.
• OTP-based verification (one-time passwords) is used for patient authentication in accordance with PECA 2016 electronic transaction provisions.

5. Orders, Pricing and Payments

• All prices are displayed in Pakistani Rupees (Rs./PKR) and include applicable taxes unless stated otherwise.
• Subscription plans renew automatically until cancelled. You may cancel anytime from your patient portal.
• Payments are processed through licensed payment gateways operating in Pakistan (e.g., JazzCash, Easypaisa, card networks).
• An order is confirmed once payment is successfully verified and you receive an order confirmation.
• We reserve the right to correct pricing errors and to refuse or cancel orders where required by law.

6. Prescriptions and Pharmacy

• Medication is dispensed only against a valid e-prescription issued by a licensed practitioner.
• AXOMED partners with licensed pharmacies in Pakistan for fulfillment and delivery.
• You must be at least the age legally required to purchase the medication concerned.
• Controlled and regulated substances are handled strictly in accordance with the Drugs Act 1976 and related rules.

7. Consumer Protection

AXOMED complies with Pakistan's consumer protection framework, including the Consumer Protection Act 2022 (Federal) and provincial consumer protection legislation. You have the right to:

• Receive services of acceptable quality, as described.
• Transparent information about prices and terms before purchase.
• Apply for a refund or replacement under our Refund Policy.
• Lodge a complaint through our support channels; complaints are resolved in accordance with applicable law.

8. Privacy and Data Protection

Your personal and health data is processed in accordance with our Privacy Policy, applicable data protection principles in Pakistan, and the confidentiality requirements of the PECA 2016. Health data is encrypted, access-controlled and never sold to third parties.

9. Acceptable Use

• You agree not to misuse the platform, attempt unauthorized access, or interfere with its operation.
• You agree not to upload harmful content, malware, or content that infringes third-party rights.
• Misuse of electronic systems is prohibited under the PECA 2016 and may result in legal action.

10. Intellectual Property

All content, branding, design, software and technology on the AXOMED platform are the property of AXOMED or its licensors and are protected under Pakistan's Intellectual Property Organization (IPO-Pakistan) laws, including the Copyright Ordinance 1962 and the Trademarks Ordinance 2001. You may not reproduce, distribute or commercially exploit our content without written permission.

11. Limitation of Liability

• To the maximum extent permitted by law, AXOMED's liability is limited to the amount paid by you for the service concerned.
• We are not liable for indirect, incidental or consequential damages arising from your use of the platform.
• Nothing in these Terms limits liability that cannot be excluded under Pakistani law.

12. Termination

We may suspend or terminate your access where you breach these Terms, where required by law, or to protect the safety and integrity of the platform. On termination, outstanding obligations remain in effect.

13. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on this page with the "Last updated" date. Continued use of the platform after changes constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Islamic Republic of Pakistan. Disputes shall be subject to the exclusive jurisdiction of the courts of Karachi, Pakistan, unless otherwise required by law. Where applicable, you may also approach the relevant consumer protection authority.
